Type Description
Reason The proposal would result in the creation of dwellings where the housing requirement for rural areas in the District have been reached and at a period where the district has a housing land supply of 6.6 years. The proposal would be in conflict with the spatial and housing allocation strategies set out in the development plan and fails to deliver environmental improvements or satisfy any of the exceptional circumstances set out by Policy R1 of the adopted West Northamptonshire Joint Core Strategy. Therefore, the proposal is in conflict with the development plan and the aims of national and local planning policies which seek to promote sustainable development. The development is contrary to Paragraphs 8, 10 and 12 of the National Planning Policy Framework 2019; Saved Policies GN1 (B) (E), HS6, HS22 (A) (C) of the adopted Daventry District Local Plan 1997; Policies SA, S1 (D1) and R1 of the adopted West Northamptonshire Joint Core Strategy 2014; Policies SP1 (E); and Policy H1 (a) (b) (c) (g) of the Moulton Neighbourhood Development Plan Made 2016.
Reason . The proposed development would create an unsatisfactory relationship with the site and surrounding environment. The proposal would result in an incongruous form of backland development that would detract from the character, layout and appearance of the site and surrounding gardens and lead to overdevelopment of the site. The proposal would be contrary to the national and local planning policies which seek to promote good/ high quality design, ensure planning proposals relate well with the site and surroundings; add to the quality of the area, promote local distinctiveness, respect the surrounding built and natural environment, and protect/ maintain the integrity of gardens that makes a contribution to the form, character and setting of the settlement. Therefore, the proposal would be contrary to Paragraphs 122 d), 127 a), b) and c) of the National Planning Policy Framework 2019, Saved Policies GN1 (B), GN2 (A), EN42 (A) and (C), HS22 (A) (C) and HS36 (C) (D) of the adopted Daventry District Local Plan 1997; Policy S10 (i) of the adopted West Northamptonshire Joint Core Strategy 2014; Policies SP1 (G), RA1 (C iii, iv) of the submission Settlements and Countryside Local Plan (Part 2) for Daventry District 2018 (Examination held in June 2019); and Policy H1 (a) (b) (g) of the Moulton Neighbourhood Development Plan Made 2016.
Reason The submitted information fails to demonstrate that the site would be of a sufficient width to accommodate the proposed dwellings, together with the required access driveway. In the absence of a suitable and safe means of access being provided to serve the dwellings so as to prevent conflict between vehicular movements entering and leaving site, in particular, at the point where vehicles egress onto the public highway, it has not been demonstrated that the proposal would not have an unacceptable impact on highway safety. Therefore, the proposal would be contrary to Saved Policy GN2 (B) (C) of the adopted Daventry District Local Plan 1997 and Paragraph 109 of the National Planning Policy Framework 2019.
Reason The proposed development due to scale and nature would lead to the loss of the existing on-site trees and no tree survey or arboricultural information has been submitted with the application to demonstrate that consideration has been given to the on and off-site trees. The proposal, therefore, is contrary to Paragraph 127 a) b) c) of the National Planning Policy Framework 2019, Policy S10 (i) of the adopted West Northamptonshire Joint Core Strategy 2014; Policies SP1 (G), ENV1 (D), ENV10 (v) of the submission Settlements and Countryside Local Plan (Part 2) for Daventry District 2018 (Examination held in June 2019); and Policy H1 (g) of the Moulton Neighbourhood Development Plan Made 2016.
Reason In the absence of any ecological/ protected species surveys, the applicant has failed to demonstrate that protected species are not present and would not be affected by the proposed development. The proposal, therefore, would be contrary to Paragraph 175 of the National Planning Policy Framework 2019, Policy S10 (i) and BN2 of the adopted West Northamptonshire Joint Core Strategy 2014; Policies SP1 (G) and ENV5 (B) of the submission Settlements and Countryside Local Plan (Part 2) for Daventry District 2018 (Examination held in June 2019); Policy H1 (g) of the Moulton Neighbourhood Development Plan Made 2016 and the adopted Biodiversity SPD for Daventry 2017.
Informative In making this decision, the Local Planning Authority has had regard to the requirements of Paragraph 38 of the National Planning Policy Framework. Whilst consideration has been given to the planning merits/ benefits of the proposal, it is not considered that these would outweigh the harm identified
