Type Description
Condition The development hereby permitted shall be begun before the expiration of 3 years from the date of this permission.
Reason To comply with Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
Condition The development shall be carried out strictly in accordance with drawing nos 05B and 06B received 24/7/19; 07A received 11/6/19; 02 valid 29/4/19
Reason To ensure development is in accordance with the submitted drawings and to enable the Local Planning Authority to consider the impact of any changes to the approved plans.
Condition No demolition or construction work (including construction related deliveries to or from the site) that causes noise to be audible outside the site boundary shall take place at the site outside the hours of 0800 and 1800 Mondays to Fridays and 0830 and 1300 on Saturdays, and at no times on Sundays or Bank Holidays unless otherwise agreed with the local planning authority.
Reason To ensure the protection of the local amenity throughout construction works.
Condition The ceiling and floor that separates the residential and commercial unit shall resist the transmission of airborne sound such that the weighted standardised level difference (DnT,W +Ctr) shall not be less than 53 decibels. The weighted standardised level difference (DnT,W) and spectrum adaptation term, Ctr, is quoted according to BS EN ISO 140-4:1998 Acoustics - Measurement of sound insulation in buildings and of building elements - Part 4: Field measurements of airborne sound insulation between rooms.
Reason In the interests of residential amenity.
Condition The roof of the extension shall be constructed in materials to match those used in the existing building.
Reason In the interests of visual amenity and to ensure that the materials are appropriate to the appearance of the dwelling.
Condition Notwithstanding the provisions of the Town & Country Planning (General Permitted Development) (England) Order 2015 (as amended) (or any Order revoking and re enacting that Order with or without modification), no windows/dormer windows, other than those expressly authorised by this permission, shall be constructed.
Reason To safeguard the amenities of nearby residents.
Condition The obscure glass shown on the submitted and approved plans shall be installed before any of the flats are first occupied and shall not be removed without the prior express consent in writing of the Local Planning Authority. (Replacement of the glass of an identical type would not necessitate the Council being notified.)
Reason This condition is imposed because the Local Planning Authority consider that if plain glass was to be used in this location, the amenities of the dwellings at Glebe Cottage, The Skerries and Rose Cottage would be adversely affected due to overlooking.
Condition All first floor windows on the east, north and west elevations shall be fitted so that they open with a bottom-hinge only before any of the flats are first occupied and shall not be removed without the prior express consent in writing of the Local Planning Authority. Any side or top opening shall be restricted.
Reason This condition is imposed because the Local Planning Authority consider that if side or top opening hinges are used in this location, the amenities of the dwellings at Glebe Cottage, The Skerries and Rose Cottage would be adversely affected due to overlooking.
Condition Before the flats are first occupied the external door leading to the staircase extension shall be fitted with a soft-close mechanism and this shall be maintained and not removed without the prior express consent in writing of the Local Planning Authority.
Reason In the interests of residential amenity of the neighbouring property.
Condition No external storage shall take place other than within the areas delineated on the approved plan.
Reason In the interests of visual amenity.
Informative In making this decision, the Local Planning Authority has had regard to the requirements of paragraph 38 of the National Planning Policy Framework.
Informative The applicant’s attention is drawn to the fact that the Council has identified this development as liable for Community Infrastructure Levy (CIL) payments under the 'Daventry District Council Community Infrastructure Levy Charging Schedule –Approved' (31st July 2015 ) which has been implemented by the District Council under the provisions of 'The Community Infrastructure Levy Regulations 2010 (as amended).' Accordingly, unless exemptions have been sought under the provisions of the CIL Regulations, payment of CIL charges will be payable to the Council upon commencement of development.
Reason To increase the efficiently of the use of the space available for parking.
Condition Before the first occupation of any of the flats hereby permitted, the forecourt at the front of the site shall be physically marked out with standard car parking spaces in accordance with further details that have been submitted to and approved in writing by the local planning authority.
